Of course, there are too many Americans who just don't care what happens... and we are now reaping the "benefits" of that.

I agree with you...but there was never any question that someone qualified to be nominated as a justice to the Supreme Court would be smarter than 90% of the senate. I also agree with you that Roberts is taking the smartest way out and that he is being completely honest. I'd try to avoid answering the questions too...especially the questions he'll be asked about the commerce clause. If he were to say what I think he truly believes about how that part of the Constitution has been abused to the detriment of American citizens he'd be demonized by the loonies on the left and the right.
That said, a great disservice was done to our country by those senators from both parties who let Ginsberg and other justices go through their confirmation hearings without being required to address their understanding of what the Constitution means. The idea that we have to watch someone obtain a seat on that all powerful court without ever hearing how they plan on interpreting the constitution is scary and dumb.

Have you been watching the hearings? Are you disappointed by how Roberts answered the questions? I haven't watched all of it and it is a cop out to say that he needs a real case with arguments made on both sides, but it is an honest cop out.

From what I've seen Roberts is far smarter than the people questioning him.
